Murder in the First Degree charges may be brought against someone believed to have caused the death of another person while committing certain serious crimes, such as burglary with intent to cause death. It also can be charged in cases involving criminal sexual conduct.
Murder in the Second Degree is a less serious crime than Murder in the First Degree because, though the defendant intended to kill someone, there was no premeditation or planning involved. Second degree murder may also be a killing caused by the offender’s obvious lack of concern for human life.
Murder of the Third Degree under Minnesota law, is defined as an act involving an eminently dangerous act without regard for human life. Originally, the state’s definition of third-degree murder solely included depraved-heart murder. In 1987, an additional provision was added for drug-related offenses “without intent to cause death, proximately caus[ing] the death of a human being by, directly or indirectly, unlawfully selling, giving away, bartering, delivering, exchanging or distributing a controlled substance classified in Schedule I or II.”
Unlike charges of murder, which are the most serious range of charges involving homicide, manslaughter is a less culpable offense. While a murder involves the death of another person, manslaughter either involves a death caused by an act in the heat of passion prompted by words or actions, or an unreasonable risk created by culpable negligence.
