IF YOUR TELLING THE POLICE THE 100 PERCENT TRUTH, AND YET THEY STILL DONT BELIVE YOU AND SAY (if you dont tell us the truth their will be a problem) SO YOU RESPOND SAYING “IM TELLING YOU THE TRUTH, I DONT KNOW WHAT TO SAY. THEN THEY SAY “WE KNOW YOUR NOT”
WHAT IF YOU LIE TO THE POLICE, TELLING THEM WHAT THEY WANT TO HEAR, BECAUSE YOU WERE SCARED AND DID NOT KNOW WHAT ELSE TO TELL THEM (BECAUSE YOU WERE TELLING THEM THE TRUTH IN THE FIRST PLACE, BUT THEY DIDNT BELIVE YOU) DONT YOU THINK IF THE POLICE SAY “IF YOU TELL US THIS HAPPENED WE WILL KNOWIT WAS ACCIDENT” THAT THE PERSON WOULD BELIVE THEM??? TELL THEM A LIE, IN ORDER FOR THE POLCIE TO BELIEVE THAT LIE AND IT BE A ACCIDENT.
The defendant tells the police “IM FROM BOSTON” – WHICH IS THE TRUTH
POLICE SAY “WE DONT BELIVE YOU, IF YOU DONT TELL US THE TRUTH THEIR WILL BE A PROBLEM”
The defedant still says “IM FROM BOSTON”
POLICE SAY ‘IF YOU JUST TELL US YOUR FROM ALASKA WE WILL BELIVE YOU”
So the defendant is scared (thinks the police dont belive hes from boston and is lieing)
Defedant doesnt know what else to tell the police and doesnt want “THEIR TO BE A PROBLEM LIKE THE POLICE SAID” so the defendant told the police the wanted they wanted to hear “and belive” “IM FROM ALASKA” EVEN THOUGH ITS A LIE
First, if you are being questioned, you need to remember this: You have the right to remain silent. Use it. It is scary, but, you have to refuse to speak. The police are scary and they can intimidate people. They can also lie to you to get you to make a statement.
Second, request an attorney. Even if you can’t afford an attorney, you have the right to have an attorney appointed (and one will be appointed if you ask). It is an intimidating situation being questioned by police, therefore you have the right to even the playing field by having an attorney present to fight for you and protect your rights.
Many people are forced into false confessions because they want to get the police off of their backs. False confession land people in jail or prison for crimes they never committed.
So, in this example that you provided, if this were the actual situation the first thing to do is to say, “I can not answer any more questions without an attorney present.” The police at that point, must stop questioning you. DO NOT JUST AGREE WITH THE POLICE TO GET THEM OFF YOUR BACK OR TO THINK YOU ARE INNOCENT. I repeat, the police can lie to you to get you to confess.
To me, this sounds like a classic interrogation technique. This is a technique where the police rationalize the incident and make it sound innocent. The police will say, “Oh, it was an accident… ok, we will tell the district attorney that. And we will make it easy for you… act” The police are trying to get you to say something like, “OK, I did it, but it was an accident”. But, what they are really interested in is the part where you say, “OK, I did it”. That is a confession. Get it? Please don’t fall for this. It sounds like the police don’t have a case and need your statement and are trying to get it anyway they can.
Contact a lawyer immediately or call your local public defender office. In the meantime, remain silent. Do not meet with the police. Do not talk to the police on the phone. Do not agree to an “interview”. Get an attorney right away.
